The weekend’s highest-value story is still unresolved. A Plymouth County jury has now spent about 10 hours on Lindsay Clancy’s triple-murder case and will resume Monday morning without a verdict. In the Bronx, a judge found Dimone Fleming not criminally responsible for killing her two young sons — a postpartum-psychosis resolution prosecutors accepted, and one drawing national attention precisely because the Clancy jury is out. California cold-case investigators also closed a 34-year gap: the last unnamed victim of Keith Hunter Jesperson, the “Happy Face Killer,” has been identified as Lydia Jane Wade McWhorter. On the street-crime side, NYPD arrested parolee Jesus Acosta on Saturday in two alleged robbery-homicides 48 hours apart. A Los Angeles jury rejected an insanity defense for caretaker Jianchun Li in the 2023 killings of two elderly women in his care. In Maryland, state police charged Jason Timothy Simpson with second-degree murder after the medical examiner ruled Ashley Silverman’s death a homicide, not the hanging Simpson described.

Plymouth Jury Still Out on Clancy

Jurors in the murder trial of Lindsay Clancy ended Friday without a verdict and will resume deliberations Monday at 9 a.m. ET. The 12-person panel — nine women and three men — sat about 3.5 hours Thursday and more than 6.5 hours Friday, roughly 10 hours total. On Friday they asked to see Clancy’s prescription pill bottles and the knife associated with her suicide attempt after the children were found. Judge William Sullivan sent them home for the weekend and ordered them not to discuss the case.

Clancy, 36, a former labor-and-delivery nurse, has pleaded not guilty to three counts of murder in the January 24, 2023 deaths of Cora, 5, Dawson, 3, and Callan, 8 months, at the family’s Duxbury home. The verdict form allows first-degree murder (deliberate premeditation or extreme atrocity or cruelty), second-degree murder, manslaughter, not guilty, or not guilty for lack of criminal responsibility. Prosecutors argue the killings were a choice. The defense argues postpartum psychosis left her not criminally responsible. No verdict as of this briefing. Trial is in Plymouth Superior Court; the Plymouth County District Attorney’s Office is prosecuting.

The country’s most closely watched active child-homicide trial is now in the jury’s hands on the criminal-responsibility question.

Bronx Judge Finds Fleming Not Responsible

A Bronx judge found Dimone Fleming not responsible by mental disease or defect for the 2022 deaths of her two young sons after prosecutors and the defense agreed she was in a psychotic state. Daishawn Fleming, 3, and Octavius Canada, 11 months, died at a family shelter in Mount Hope on November 26, 2022. Fleming had originally been charged with first-degree murder. Judge Audrey Stone accepted the not-responsible finding. She remains in custody for psychiatric evaluation, with a further hearing set for September 18.

Weekend coverage tied the Monday courtroom resolution directly to the Clancy deliberations. Psychiatrists for both sides described Fleming as grossly psychotic that night. She had been diagnosed with major depressive disorder, prescribed medication she was not taking, and was living in a shelter. Happy Face Killer Victim Named McWhorter

Riverside County investigators identified “Claudia,” the last unnamed homicide victim tied to convicted serial killer Keith Hunter Jesperson, as Lydia Jane Wade McWhorter, 26, of Texas. Her remains were found August 30, 1992, in brush at a turnout along Highway 95 about seven miles north of Blythe. Jesperson pleaded guilty in Riverside County in 2010 to her murder and was sentenced to 25 years to life; he is serving multiple life sentences in Oregon. No new defendant.

The Riverside County District Attorney’s Office announced the identification Thursday, August 27, with national coverage Friday and Saturday. A public tip led investigators to a maternal relative; a DNA comparison confirmed the match. Jesperson, a long-haul truck driver known for smiley-face letters to the press, had told investigators he knew the woman only as Claudia. The Riverside Cold Case Homicide Team used Othram DNA work. With this identification, every victim tied to the murders for which he was convicted has a name.

A 34-year forensic gap is closed. Her family can finally bury her under her own name.

NYPD Arrests Parolee in Two Homicides

Police arrested Jesus Acosta, 31, on Saturday morning after a multi-day hunt in two alleged store robberies that left MD Yousef, 44, and Tayvon Shuler, 33, dead. Yousef worked at American Best Wings & Pizza in Brownsville, Brooklyn, and was a father of two. Shuler was a customer at 149 Grill & Deli in Mott Haven / Melrose in the Bronx. A third man was shot in the leg and survived. Acosta is charged with murder, attempted murder, manslaughter, robbery, and weapon counts. He is presumed innocent.

NYPD announced the arrest Saturday. Officials say the first shooting was just after midnight August 23 in Brooklyn and the second about 12:15 a.m. August 25 in the Bronx. Acosta was identified after his parole officer recognized him on surveillance video. The FBI had posted a $25,000 reward; United Bodegas of America offered $10,000 more. He was located after an anonymous 911 call near a Soundview park, a short distance from a Bronx precinct. State records show he was released on parole in April after serving about 10 years for assault and a weapons conviction. FBI New York Field Office assisted the hunt.

Diamond Bar Caretaker Found Sane

After convicting Jianchun Li of two first-degree murders, a Los Angeles County jury on August 27 rejected his insanity defense and found him legally sane. The victims were Monica Moon Lee, 75, who used a walker, and Hee Sook Park, 83, at Happy Homes Care / Happy Home Care For Elderly, 23801 Sapphire Canyon Road, Diamond Bar. Two counts of first-degree murder with a multiple-murder special circumstance. Li faces life without parole at a September 3 sentencing in Pomona.

The guilt-phase verdict came August 20. The sanity-phase verdict came August 27; the Los Angeles County District Attorney’s Office issued its formal release August 28. Prosecutors say that on the morning of June 24, 2023, overnight caretaker Li took each woman, about 30 minutes apart, into the same bathroom and killed them. Firefighters pronounced both dead at the scene. District Attorney Nathan J. Hochman said Li was “the very person expected to keep them safe.” Elder Abuse Section of the DA’s office.

Cecilton Hanging Ruled a Homicide

Maryland State Police charged Jason Timothy Simpson, 28, of Cecilton, with second-degree murder after the medical examiner ruled Ashley Silverman’s June death a homicide by asphyxiation. Silverman, 28, of Cecilton, was found dead in the 100 block of West Main Street. State police identified her as 28; charging papers described her as the mother of four. Simpson is held without bond at the Cecil County Detention Center. He is presumed innocent.

Troopers were called to a medical-distress report about 1:45 a.m. on June 18 and found Silverman dead. Charging papers say Simpson told investigators she had hanged herself from a backyard swing set. The Office of the Chief Medical Examiner later ruled the death a homicide. Court records cited by the Cecil Daily describe a documented history of strangulation assaults. Detectives say Simpson called his mother three times before calling 911. He was arrested Thursday, August 27. Maryland State Police Homicide Unit; Cecil County State’s Attorney’s Office.

Coast Guard Lt. Connor Scott Overstreet, 29, was killed in a Skyway, Washington, shooting on August 23. King County still has no named suspect. No new official identification in the last 24 hours.
