Marian Green Case: What Is Known About the Scarsdale Murder Charge

FILE NO. 0145Case status Active

Filed By Mandi Martyr10 min read

Marian Green, 71, a longtime advocate for Scarsdale residents with disabilities, was found dead inside her home in the early hours of July 7, 2026. Her son, Chester Green, was taken into custody at the scene. On October 14, 2026, he was arraigned in Westchester County Court on an indictment charging him with Murder in the Second Degree and three counts of Criminal Possession of a Weapon in the Fourth Degree. He pleaded not guilty, remains remanded at the Westchester County Jail, and is due back in court on December 2, 2026. He is presumed innocent.

Status as of October 16, 2026

According to Westchester County District Attorney Susan Cacace’s office, Chester Green, now 27, was arraigned on Wednesday, October 14, before Judge Melissa Loehr. Murder in the Second Degree is a Class A-1 felony. Each weapons count is a Class A misdemeanor. The indictment alleges that between about 3 p.m. on July 5 and about 2 a.m. on July 7, 2026, he “repeatedly beat and stabbed his mother to death with a machete, an axe, and a kitchen knife inside their Butler Road home in Scarsdale.” No trial date has been announced.

Marian Green was a widow who lived in a split level house on Butler Road with her adult son. Scarsdale10583, the village news site, reported that the house sat next to the kindergarten playground at Fox Meadow School, and that she often traveled to Florida to care for her elderly mother.

For many years she was active on C.H.I.L.D., the Children Having Individual Learning Differences committee sponsored by the parent teacher council. Later she joined, and chaired, the Scarsdale Village Advisory Council for People with Disabilities. Scarsdale Mayor Justin Arest said she devoted “well over a decade” to the council, “including as its Chair, as well as earlier years chairing the C.H.I.L.D. committee supporting students with learning differences.”

She was a regular at Village Board meetings. Scarsdale10583 recorded some of what she asked for:

  • At a November 2025 meeting (WABC placed a sidewalk discussion with trustees the previous December), she urged trustees to move ahead with concrete sidewalks, which are more accessible than asphalt walkways. She called them an investment with an “immediate ROI and long term” impact and asked the board not to let the project become a slow “drip, drip, drip.”
  • In July 2024, as the village planned a new pool complex, she listed what it needed: “We need handicapped parking, handicapped bathrooms, sinks and soaps, non-slip floors.” She also asked, “Will there be quiet space?”
  • When the village discussed new parking meters, she asked for extra time for disabled drivers so they would not be ticketed as readily if they were slower returning to their cars.

Her fellow council members said in a statement: “She lived to serve and advocate throughout the village.” Former Village Trustee Jeremy Wise, the board’s liaison to the council, said she “should be remembered for her effective advocacy, exceptional kindness, generosity and commitment to the public good.”

Butler Road, July 7, 2026

The village was still cleaning up from a storm on the night of Saturday, July 4, when, according to Scarsdale10583, winds of about 60 miles per hour brought down trees and power lines and left hundreds without power, many for days.

Early on Tuesday, July 7, Marian Green was found dead inside her home. Scarsdale police at first announced only that they were investigating the death of a person found at a home on Butler Road. That day Scarsdale and Westchester County police closed Butler Road between Hampton and Brewster roads, set up a tent and appeared to be conducting a forensic investigation. The street stayed closed into the evening. News 12 reported a large police presence from Tuesday afternoon into the night and yellow tape around the house near the corner of Brewster Road the next day. Neighbors told News 12 they were surprised by the response in a typically quiet neighborhood.

The Arrest and First Arraignment

On Wednesday, July 8, Scarsdale police identified the victim and said her 26 year old son had been taken into custody at the scene and charged with Murder in the Second Degree. The police statement, quoted by Scarsdale10583, said he “was arraigned this afternoon (Wednesday July 8, 2026) at White Plains Hospital by the Honorable Erin McGoey, and remanded to the Westchester County Jail without bail.” The District Attorney’s office said the arraignment was virtual. He was ordered back to court, Scarsdale Village Court according to News 12, on August 5.

WABC reported on July 9 that police had been called to the house on a disturbance call early Tuesday morning, and that Chester Green was taken from the scene to the hospital for observation and arraigned at his bedside. One resident told the station: “Things like that don’t really happen around here. So, it’s disturbing.” Investigators had by then been at the house for more than 24 hours.

The official statements we reviewed do not say why he needed hospital observation. A Journal News report on the October arraignment, citing court documents, is said to describe what he told police that morning, but it was paywalled and we could not read it, so we do not repeat its contents here.

What the Felony Complaint Alleged

The first charge rested on a felony complaint. In the District Attorney’s words: “between July 5 and July 7, the defendant caused the death of his mother, 71-year-old Marian Green, at their Fox Meadow home by stabbing and beating her multiple times about her body with a sharp object and with a blunt instrument.”

Cacace said: “Like everyone in this county, I am shocked at the horrifying death of Marian Green and the manner in which she was killed. This tragedy is only further compounded by the familial relation between the victim and suspect in this case.” She praised the detectives and investigators “who have pored over this case non-stop since the discovery of Ms. Green’s body.” Police Chief Steven DelBene commended his detectives, the Westchester County Police and the District Attorney’s office “for their careful investigation of this case.”

The investigation was carried out by the Scarsdale Police Department, the Westchester County Department of Public Safety and the District Attorney’s Criminal Investigators Squad. The prosecutors are Assistant District Attorneys Brianna Ciuffi and Caroline Zicca and Bureau Chief Jonathan Strongin of the Trials Division.

A felony complaint is the prosecution’s first charging paper. The October indictment, voted by a grand jury, is the charge he will face at trial, and it is more specific than the complaint in three ways:

  • The time window narrows from “between July 5 and July 7” to between about 3 p.m. on July 5 and about 2 a.m. on July 7.
  • “A sharp object and a blunt instrument” become three named weapons: a machete, an axe and a kitchen knife.
  • Three counts of Criminal Possession of a Weapon in the Fourth Degree are added to the murder count.

The August 5 appearance came between the two. We found no public report of what happened at it.

At the October arraignment Cacace said: “Chester Green has been indicted for the murder of his mother, Marian Green, in a horrific and senseless act of violence that has deeply shaken our community.” She said her office was committed to “vigorously prosecuting this deeply disturbing case.”

The Charges in New York Law

New York’s Penal Law section 125.25 defines Murder in the Second Degree in several ways. The first, and most common, is causing a death “with intent to cause the death of another person.” Others cover killings “under circumstances evincing a depraved indifference to human life” and deaths caused during certain other felonies. The press releases do not say which subdivision the indictment charges.

The intentional murder subdivision carries an affirmative defense: that the defendant “acted under the influence of extreme emotional disturbance for which there was a reasonable explanation or excuse.” If proved, the defense reduces the crime to manslaughter but does not excuse it. Nothing in the public record indicates whether any defense has been raised here.

Under Penal Law section 70.00, the maximum term for a Class A felony is life imprisonment. For a Class A-I felony the court sets a minimum of between 15 and 25 years, apart from special categories that do not appear to apply here.

Criminal Possession of a Weapon in the Fourth Degree, Penal Law section 265.01, includes possessing “any dagger, dangerous knife, dirk, machete, razor, stiletto” or “any other dangerous or deadly instrument or weapon with intent to use the same unlawfully against another.” The three counts appear to match the three weapons named in the indictment, a machete, an axe and a kitchen knife, though the release does not pair them count by count.

Scarsdale10583 wrote that the community was “reeling” over a murder on a quiet street “where residents know each other’s names.” Residents it spoke with recalled the village’s few earlier killings: the death of 20 year old Bonnie Garland in 1977; Jean Harris’s killing of the Scarsdale Diet doctor in 1980; and the 2016 killing of Robin Goldman by her husband. “This time,” the site wrote, “the victim is a woman who spent her life looking out for others.”

What Is Not Known

Prosecutors have not publicly described a motive. No medical examiner findings beyond the allegations in the charging papers have been released. Nothing in the official statements addresses Chester Green’s background, his health, or what took place in the house in the hours between the start of the alleged window and the discovery. Those questions belong to the court process, and we do not speculate on them.

Legal Status

Chester Green, 27, is charged by indictment with Murder in the Second Degree, a Class A-1 felony, and three counts of Criminal Possession of a Weapon in the Fourth Degree, Class A misdemeanors, in the death of his mother, Marian Green. He pleaded not guilty on October 14, 2026, in Westchester County Court, is remanded at the Westchester County Jail, and is due back in court on December 2, 2026. The charges are accusations.
